Man charged in drug overdose death wants statements suppressed

The attorney for a man charged with first degree reckless homicide in the death of a Newbold woman two years ago has filed a motion to suppress the defendant’s statements.

Dalton U. Kampf, 25, of Stevens Point was arrested in March 2021 and charged with allegedly selling heroin to a woman who died in August 2019 after using the drug.

Kampf was in Oneida County court Nov. 2 for a pre-trial conference. Kampf’s attorney Eric P. Sheets wants statements Kampf made to Oneida County law enforcement thrown out and asked for a hearing to be scheduled.

In the motion to suppress filed this week, Sheets stated he notified Det. Sgt. Robert Hebein of the Oneida County Sheriff’s Office Sept. 19, 2019, that he had been retained as Kampf’s lawyer and that he would not be answering any questions. Sheets stated that without notifying him, the detectives twice interviewed Kampf.

The criminal complaint against Kampf filed by Oneida County detectives references a February 2020 interview in Portage County where the defendant agreed to answer their questions and stated, in part, “Today might be the day I turn into a rat and go to prison for six…years.”

A motions hearing is scheduled for 2 p.m. Jan. 26, 2022 before Judge Michael Bloom.

The penalty for a first degree reckless homicide conviction is a fine of up to $100,000 and/or up to 40 years in the Wisconsin prison system.  Kampf is also charged with possession with intent to deliver heroin, less than 3 grams. If convicted, that charge carries a fine of up to $25,000 and/or up to 12 years six months in prison.
